SUBJECT: Urgent Formal Complaint and Request for Intervention Regarding Breach of Contract, Severe Hardship, and Fraud Involving a U.S. Citizen and a Kenyan Citizen

To Whom It May Concern,

I am writing this letter to bring to the immediate attention of the U.S. Embassy in Nairobi and the U.S. Department of State a matter involving grievous harm, breach of contract, and severe financial and emotional distress caused by a U.S. citizen  and a Kenyan citizen residing/operating in Kenya ( their names are revealed in the email communication )

In 2020, the aggrieved parties ( names known to the main aggrieved person 1 ) entered into a binding written contract with these The Kenyan Violator of the Agreement. The agreement was a work contract that had no termination nor renewal date operating instead as a long-term/perpetual agreement with a mandatory compensation increase clause every six months. Living witnesses exist who can formally verify and attest to the authenticity and terms of this contract.

Despite the clear legal agreement, the U.S. citizen and Kenyan citizen wrongfully terminated the written contract without issuing any written notice of dismissal. They claimed that the contract had reached its conclusion; however, the terms of the contract explicitly demonstrate that it contained no termination date, operating instead as a long-term/perpetual agreement with a mandatory compensation increase clause every six months. Living witnesses exist who can formally verify and attest to the authenticity and terms of this contract.

For over five years, the aggrieved parties have made continuous efforts to write to and communicate with both individuals to resolve this matter amicably. These attempts have been met with total silence and refusal to engage.

As a direct result of this wrongful termination and withholding of earned funds, the aggrieved parties have suffered catastrophic hardship:

  • Severe Financial and Physical Distress: The aggrieved parties have been left unable to secure basic human necessities, including food, clothing, adequate shelter, and necessary medical care, pushing them to the brink of life-threatening distress.

  • Loss of Life and Family Impact: The severe financial deprivation and prolonged stress have deeply impacted their families, contributing directly to the declining health and ultimate passing of beloved family members whom the aggrieved parties could not financially assist or care for.

  • Ongoing Urgent Health Crisis: Loved ones and dependents currently face critical healthcare issues, and without the funds wrongfully withheld, the aggrieved parties remain unable to provide essential medical care or support.

Requested Actions and Relief:

  1. Investigation and Reprimand: We request that the U.S. Embassy and U.S. Department of State review this matter regarding the conduct of the U.S. citizen involved and issue appropriate reprimands or legal/administrative follow-up.

  2. Financial Restitution: Immediate intervention to facilitate the payment of all outstanding monies, compensation increases, and damages due to the aggrieved parties as stipulated under the 2020 contract.

  3. Re-engagement and Mediation: A requirement for the two individuals to sit down with the aggrieved parties to renegotiate terms, address past grievances, and chart a way forward regarding the Beit Ahavah project and property initiatives.

Due to the extreme hardship and critical nature of current health issues, urgent action and intervention are requested.

Sincerely,

Mr. Arthur Owiti / Name of Aggrieved Party]
